These terms and conditions (the “Terms and Conditions”) govern the use of www.jigiweb.com
(the “Site”). This Site is owned and operated by JigiWeb CIC (Company No. 17257144)
This Site provides information about, and enables the purchase of, bespoke website design, build, content writing, and related digital services.
By using this Site, you indicate that you have read and understand these Terms and Conditions and agree to abide by them at all times.
Intellectual Property
All content published and made available on this Site, including but not limited to text, images, logos, branding, documents, downloadable files, and website design elements relating specifically to www.jigiweb.com, is the intellectual property of JigiWeb CIC or its licensors.
Intellectual property created for a client as part of a website build remains the property of JigiWeb CIC until full payment has been received. Upon receipt of full payment, ownership of the final website content and design created specifically for the client transfers to the client, excluding any third-party software, plugins, themes, fonts, or licensed assets.
JigiWeb CIC retains the right to display completed client work for portfolio, promotional, and marketing purposes unless otherwise agreed in writing.
Accounts
Visitors to this Site are not required to create an account in order to browse or make enquiries.
Where access credentials are provided as part of a website build or maintenance service, these relate solely to the client’s own website and not to an account on the JigiWeb CIC Site.
Sales of Goods and Services
These Terms and Conditions govern the sale of goods and services available on our Site.
The following services are available on our Site:
Website design, build, content writing, and optional website maintenance services
The services will be paid for in full at the time the services are ordered, unless otherwise agreed in writing.
These Terms and Conditions apply to all goods and services that are displayed on our Site at the time you access it, including services listed as out of stock. All information, descriptions, or images provided are as accurate as possible, but we cannot guarantee absolute accuracy. You agree to purchase goods and services from our Site at your own risk.
We reserve the right to modify, reject, or cancel your order whenever necessary. If we cancel your order after payment has been processed, you will receive a refund equal to the amount paid. It is your responsibility to monitor your payment method to verify receipt of any refund.
All services provided by JigiWeb CIC are tailored to the client’s specific requirements. As such, timelines, outcomes, and results may vary depending on client input, third-party services, and technical constraints beyond our control.
Third Party Goods and Services
Our Site may offer goods and services from third parties. We are not responsible for the availability, performance, accuracy, or continued operation of any third-party goods or services, including but not limited to hosting providers, domain registrars, plugins, themes, software tools, or external platforms. Any issues arising from third-party services fall outside the control of JigiWeb CIC.
Package Inclusion
Our standard website package includes the design, build, and written content for a professional business website.
The exact features, pricing, and inclusions of any package are those displayed on our website or set out in a written proposal at the time of purchase.
A standard website package may include:
- A homepage
- An about page
- Up to two service or product pages, or one service or product page and one location page
- A contact page with a contact form
- A blog page setup, providing a platform for you to create and manage blog posts going forward
All content is written by us based on the information you provide, and the website is fully designed and built to be responsive across desktop, tablet, and mobile devices.
The package fee covers the initial website build only. Ongoing costs such as hosting, domain registration, third-party services, maintenance plans, or optional add-ons are not included unless explicitly stated.
Any requests for additional pages, features, functionality, integrations, or services beyond the agreed package or proposal will be quoted separately.
All written content is produced based on the information supplied by the client. The client is responsible for reviewing and approving all content prior to publication. JigiWeb CIC is not responsible for inaccuracies, omissions, or legal compliance issues arising from client-provided information.
JigiWeb CIC does not provide legal, financial, medical, or regulatory advice, and makes no guarantees regarding industry-specific compliance. Clients operating in regulated industries are responsible for ensuring their website content meets all applicable legal and regulatory requirements.
Reasonable revisions to content and layout are included during the build phase. Excessive revisions or changes that materially alter the agreed scope may be treated as additional work and quoted separately.
Payments
We accept the following payment methods:
Bank transfer
By providing your payment information, you authorise us to charge the amount due using your chosen payment method.
If we believe your payment violates any law or these Terms and Conditions, we reserve the right to cancel or reverse the transaction.
Instalment and Deferred Payment Agreements
JigiWeb CIC may, at its sole discretion, agree to provide website services under an instalment payment plan or deferred payment arrangement.
Where agreed in writing, the following instalment option may apply:
- Six monthly payments consisting of five payments of £100 and one final payment of £99.
Deferred payment arrangements may also be offered on a case-by-case basis to assist clients. The exact payment schedule, payment amounts, and payment dates will be confirmed in writing prior to work commencing.
By entering into any instalment payment plan or deferred payment arrangement, the client acknowledges and agrees that:
- All website content, design work, written copy, images, layouts, links, blocks, code, styling, functionality, and any other materials or assets created, added, or supplied by JigiWeb CIC remain the property of JigiWeb CIC until all outstanding balances have been paid in full.
- Payments must be made on or before the agreed due dates.
- If a payment is missed, overdue, reversed or cancelled, we will send a written reminder identifying the amount due and allow a reasonable opportunity to pay or raise a genuine dispute.
- If payment remains overdue after that opportunity, we may suspend further work or access to unpaid deliverables after written notice, explaining what is affected and what is needed to resume the service. Any action will be proportionate and subject to applicable law.
- We will not delete client-supplied information as a debt-recovery measure. Any restriction relating to unpaid work will be explained in advance.
- Any suspension and any limitation of liability remain subject to applicable law. Nothing in these payment terms excludes liability that cannot legally be excluded or limits a consumer’s statutory remedies.
- Access rights, ownership, administrative control, and intellectual property rights will not transfer to the client until all outstanding balances have been paid in full.
- If additional work is needed to reinstate a suspended service, any reasonable charge will be explained and agreed before that work begins.
- Website hosting, domain registration, third-party subscriptions, plugins, software licences, and other ongoing third-party costs are not included within instalment or deferred payment agreements unless explicitly stated in writing.
Specialist Features
If your website requires specialist features that incur additional costs, you will be invoiced separately before work begins. Payment must be made in full prior to website handover and admin access being granted.
If you choose third-party features that require annual subscriptions, it is your responsibility to ensure renewals are paid to maintain functionality.
Specialist features may include:
Third-party plugins
Custom in-house coded features
Ownership or administrative access to the website will not be transferred to the client until all outstanding invoices relating to specialist features have been paid in full.
Additional Features
Any features requested after the initial website build will be quoted separately.
Where JigiWeb CIC provides ongoing maintenance services, any plugins, features, or code additions must be installed or implemented by JigiWeb CIC or with our prior written approval to maintain security and stability.
Unauthorised modifications that pose a security, performance or legal risk may require temporary suspension of support while the issue is addressed. We will explain the reason, the steps needed to resume support and any effect on charges. Nothing in this clause removes statutory rights to a refund or other remedy.
Website Links
By purchasing a website package from JigiWeb CIC, the customer agrees to include a discreet “Built by JigiWeb” notice in the website footer linking back to the JigiWeb CIC homepage.
The customer also agrees to display a small footer link to Complianz, our consent management partner.
Removal of these footer links without written consent constitutes a breach of these Terms and Conditions.
Time Scales
Our standard four-week delivery timeframe begins once your completed business questionnaire has been received.
Delivery timeframes are estimates and may be extended where delays are caused by late client responses, incomplete information, content approval delays, or changes to the agreed scope of work.
Website Maintenance
JigiWeb CIC may offer an optional website maintenance package.
Where a maintenance package is purchased, it is provided on a 12-month fixed-term contract commencing on the agreed start date.
Payment for the maintenance package is made by standing order and must be received in accordance with the agreed payment schedule. It is the client’s responsibility to ensure that standing order payments are set up correctly and remain active for the duration of the contract term.
The Care Plan provides responsive technical support for WordPress websites built by JigiWeb CIC. When you report a fault, we investigate and help resolve it or restore the site where a suitable backup is available. This includes help with update-related problems, broken layouts and faults arising from everyday content edits. Routine monitoring and scheduled updates are not included.
The Care Plan does not include new features, redesigns, content creation, performance optimisation or SEO services. Problems involving unauthorised changes or external services are assessed individually; any work outside the agreed support scope is explained and quoted before it begins.
The Care Plan has a 12-month minimum term. If you wish to end the service early, contact us to discuss the circumstances. Any amount payable will be explained and calculated in accordance with the agreed terms and applicable law. Where consumer law applies, charges must be fair and proportionate, taking account of services supplied, losses reasonably incurred and costs saved. Nothing in this agreement removes statutory cancellation or refund rights.
If a maintenance payment is overdue, we will send a written reminder explaining the amount due and allow a reasonable opportunity to pay or raise a genuine dispute. If the payment remains overdue, we may suspend support after written notice. We will explain what is needed to resume the service. Any suspension remains subject to applicable law and your statutory rights.
Maintenance services do not guarantee uninterrupted operation of the website and do not constitute an insurance or uptime guarantee.
Advertising Rights
We reserve the right to use your name, logo, and website as examples of work completed by JigiWeb CIC, including case studies and marketing material. Your website will not be used for any purpose other than demonstrating work completed by JigiWeb CIC.
Right to Cancel and Refunds
If you are a UK consumer purchasing a service at a distance or away from our business premises, you normally have 14 days from entering into the contract to cancel, subject to applicable legal exceptions. A consumer is an individual acting wholly or mainly outside their trade, business, craft or profession. Business customers do not generally have the same statutory cooling-off right. Any mandatory rights that apply in other countries remain unaffected.
A website design service does not lose its consumer cancellation right simply because it is bespoke or because work has started. If you want us to begin during the cancellation period, we will ask for your express request before starting.
If you cancel after expressly requesting an early start, you may be required to pay a proportionate amount for services supplied up to cancellation, where the legal requirements for that charge have been met. You lose the cancellation right during the cooling-off period only once the service has been fully performed, if it began with your express request and acknowledgement that full performance would end that right.
Refunds and cancellation charges are assessed under the agreed contract and applicable law. Where a statutory cancellation right applies, we will refund any amount due within the legally required timeframe, less any lawful proportionate charge for work already supplied. Outside that right, cancellation charges must reflect what we are reasonably entitled to recover, including work completed and losses incurred, taking account of costs saved. Statutory remedies for services that do not meet legal requirements remain available.
To cancel, send a clear statement to hello@jigiweb.com identifying yourself, the service and your order or agreement date. You do not need to wait until work starts or stops to notify us. Where you have a statutory cancellation right, sending your notice before the applicable deadline is sufficient.
Consumer Protection Law
Nothing in these Terms limits your statutory rights under applicable consumer protection legislation.
Limitation of Liability
To the fullest extent permitted by law, JigiWeb CIC shall not be liable for indirect or consequential losses, loss of data, loss of business, or third-party service failures.
Nothing limits liability for death, personal injury, fraud, or liabilities that cannot be excluded by law.
JigiWeb CIC makes no guarantees regarding website performance, search engine rankings, traffic levels, conversions, sales, or business outcomes. Any such results depend on factors outside our control, including market conditions, competition, user behaviour, third-party hosting environments, third-party software, and external platforms. JigiWeb CIC is not responsible for issues arising from plugins, themes, or services provided and maintained by third parties.
Force Majeure
JigiWeb CIC shall not be liable for any failure or delay in performance caused by events beyond our reasonable control, including but not limited to natural disasters, acts of government, cyberattacks, hosting provider outages, internet failures, or third-party service disruptions.
Indemnity
You agree to indemnify and hold harmless JigiWeb CIC against any claims, losses, damages, or expenses arising from your use of the Site, your website content, your breach of these Terms and Conditions, or your violation of any applicable laws or third-party rights.
Applicable Law
These Terms and Conditions are governed by the laws of England.
